Terms of Use

Welcome to Ketchup. These Terms of Use ("Terms") are a binding agreement between you and Romangic Lab LLC ("Ketchup," "we," "us") governing your use of the Ketchup application and related services (the "Service").

1. Applicable Terms and Policies

By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Community Guidelines, which together form the entire agreement between you and us. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Ketchup, and you affirm that the date of birth you provide is accurate. If you are between 13 and 18, you affirm that your parent or guardian permits you to use the Service. You may not use the Service if we have previously banned you.

3. Your Account

You are responsible for your account and everything that happens under it. Keep your credentials secure, provide accurate information, and maintain one account per person. Notify us at support@ketchup.day if you believe your account has been compromised.

4. Your Content

You own the videos and other content you create on Ketchup ("Content").

So that the Service can work, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, store, process, reproduce, and transmit your Content solely to operate, secure, and improve the Service — for example, delivering your video to the circles you chose. We will not use your Content for advertising, and we will not publish, distribute, or commercially exploit it without your separate, explicit permission. This license ends when you delete the Content or your account, except for limited backup copies and records required by law.

You are responsible for your Content. You affirm that you have the necessary rights to share it, including the consent of people who appear in your videos. Content shared to a circle is for that circle: do not redistribute what friends shared with you privately.

5. Community Rules; Zero Tolerance for Objectionable Content

We have no tolerance for objectionable content or abusive users. You agree not to post or share content that is illegal, sexually exploitative (child sexual abuse material results in an immediate permanent ban and a report to authorities), pornographic, harassing, threatening, hateful, or violent, and not to use the Service to bully, impersonate, defraud, or spam.

The Service provides tools to report any content or user and to block any user instantly. We review reports and act on them within 24 hours, removing violating content and ejecting the users responsible. Depending on severity, violations result in content removal, temporary suspension, or permanent termination. We may remove any content and suspend or terminate any account at our discretion to keep the Service safe.

6. Our Proprietary Rights

The Service — including its software, design, and branding, but excluding your Content — is owned by Romangic Lab LLC and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the app on your Apple-branded device as permitted by these Terms and Apple's usage rules.

7. Restrictions

You will not: reverse engineer, decompile, or modify the Service; access it by bots, scrapers, or other automated means; circumvent security or rate limits; upload malware; harvest other users' data; or rent, resell, or sublicense the Service.

8. Purchases and Subscriptions

The Service is currently free. If we introduce paid features or subscriptions, pricing and terms will be presented before purchase, billed through your App Store account, and manageable in your App Store subscription settings.

9. Termination

You may stop using the Service at any time and delete your account in Settings → Account → Delete Account; deletion is permanent. We may suspend or terminate your account if you violate these Terms. Sections 4 (license ends as described), 10–14, and 16 survive termination.

10. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice compliant with the Digital Millennium Copyright Act to support@ketchup.day, including the work claimed to be infringed, the location of the material, your contact information, and a good-faith statement. We will remove infringing material and terminate repeat infringers.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that Content will be preserved — keep your own copies of videos that matter to you.

12. Limitation of Liability

To the maximum extent permitted by law, Romangic Lab LLC and its officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, arising from your use of the Service. Our total liability for all claims will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim.

13. Indemnification

You will indemnify and hold harmless Romangic Lab LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your Content, your use of the Service, or your violation of these Terms.

14. Dispute Resolution; Governing Law

These Terms and your use of the Service are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association in Santa Clara County, California, except that either party may bring an individual claim in small-claims court or seek injunctive relief for infringement of intellectual-property rights. You and Ketchup each waive the right to a jury trial and to participate in a class action.

15. Apple App Store

These Terms are between you and Romangic Lab LLC, not Apple. Apple has no obligation to furnish maintenance or support for the Service, is not responsible for addressing any claims relating to it, and is a third-party beneficiary of these Terms with the right to enforce them against you.

16. Miscellaneous

These Terms are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger or sale. We may update these Terms, and if changes are material we will notify you in the app; continued use after changes take effect means acceptance.
